Privacy policy
How Capsule NYC collects, uses and protects your information when you shop with us online, in the app, or in store — and the choices you have.
Your name, contact details, address and payment info when you order; device and browsing data when you visit; and whatever you send us for support or sign up for by email or text.
To run the store: take payment, ship orders, handle returns, fight fraud, answer questions, and — if you opt in — tell you about drops and sales.
Unsubscribe from any email, reply STOP to any text, opt out of targeted ads, or email us to see, correct or delete your data.
Section 1Who we are and what this covers
Capsule 383 Corp (“Capsule NYC”, “we”, “us”) runs the capsule.nyc website, the Capsule NYC mobile app, and our stores at 383 W 125th St, New York, NY 10027 and 14 W Fordham Rd, Bronx, NY 10468.
This policy explains what personal information we collect when you visit the site, use the app, shop with us online or in store, or contact us; how we use and share it; and the choices and rights you have. “Personal information” means anything that identifies you or could reasonably be linked to you.

Section 2Information we collect
Information you give us
- Order details: name, email, phone number, billing and shipping address, and payment details. Card numbers are handled by our payment processors (Shopify Payments, Shop Pay, PayPal, Sezzle and the like) and never stored on our systems.
- Account details: if you create an account — your login, saved addresses and order history.
- Marketing sign-ups: your email address or phone number when you subscribe to emails or texts.
- Support and returns: anything you include in a message to us, a contact form, or a return request, including photos of a damaged item.
- In store: contact details you give us at the register for a receipt, a hold, or a loyalty offer.
Information collected automatically
- Device and usage data: IP address, browser and device type, time zone, the pages and products you view, search terms, how you got to the site, and how you interact with it.
- Cookies and similar tech: cookies, pixels, tags and log files placed by us and by the partners listed in Sections 4 and 5. See Section 9 for how to control them.
- Shipment tracking: carrier scan events for your package, so we can show you order status.
Information from others
Payment processors and fraud-screening services tell us whether a payment succeeded and flag risky orders. Carriers (UPS, DHL, Uber Direct) send delivery updates. Advertising and analytics partners may tell us that you saw or clicked one of our ads.
Section 3How we use it
- To run the store: process and ship your order, take payment, send order and shipping confirmations, handle returns and store credit, and provide customer support.
- To keep things safe: screen orders for fraud, enforce our policies, and protect our rights and yours.
- To improve the site: understand how people use it, fix problems, and decide what to stock and feature.
- To market to you — only with your consent where required: send emails or texts about new arrivals, restocks and sales, and show you our ads on other sites. You can opt out at any time (Section 6).
- To comply with the law: tax records, legal requests, and regulatory obligations.
If you're in the European Economic Area or UK, our legal bases for this are: performing our contract with you (orders, support), our legitimate interests (security, analytics, improving the store), your consent (marketing, non-essential cookies), and legal obligations.
Section 4Who we share it with
We share personal information only with companies that help us run Capsule NYC, and only what they need to do their job. We don't sell your contact details or order history to third parties for money.

Shopify processes data on our behalf under its own privacy policy. We may also disclose information to comply with a subpoena, court order or other lawful request, to protect our rights or safety, or as part of a sale or merger of the business.
Section 5Advertising, analytics and “selling” under California law
We use cookies and pixels from advertising partners so we can show Capsule NYC ads to people who visited the site, and measure whether those ads work. That means sharing things like your IP address, device identifiers, and what you looked at or bought with Meta, Google, TikTok, AdRoll and Black Crow AI.
California law (the CCPA/CPRA) counts this kind of sharing as “selling” or “sharing” personal information, even though no money changes hands. So under that definition: yes, we sell/share personal information for cross-context behavioral advertising. You can opt out at any time on our Do Not Sell or Share My Personal Information page. We honor Global Privacy Control signals as an opt-out.

Section 6Email and text messages
We send order and shipping emails to everyone who orders — those are part of the service. Marketing emails go only to people who subscribed. Every marketing email has an unsubscribe link, or you can email info@capsuleclothingstore.com.
Text messages
By subscribing to Capsule NYC texts, you agree to receive recurring automated marketing messages (including via an automatic telephone dialing system) at the number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.
Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to any message to opt out — you'll get one confirmation text and nothing more. Reply HELP for help. Replying to a message with anything else, or asking a store associate, isn't a reliable way to opt out; please use the STOP keyword.
Section 7Your rights and choices
Wherever you live, you can email info@capsuleclothingstore.com to ask us to:
- Tell you what personal information we hold about you and how we use it (“right to know” / access)
- Correct anything that's wrong
- Delete it, subject to records we have to keep (for example, tax records of your orders)
- Give you a copy in a portable format
- Stop marketing to you, or stop selling/sharing your data for advertising
We'll verify it's you — usually by confirming details of a recent order or replying from the email on file — and respond within the time the law allows (45 days in California, one month in the EU/UK). You can have an authorized agent submit a request for you; we'll ask for proof you gave them permission. We will never treat you differently for exercising these rights.
California residents also have the right to opt out of sale/sharing (Section 5) and to limit use of sensitive personal information — we don't collect sensitive personal information as defined by the CPRA beyond what's needed to process payments. Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon and other states with privacy laws have similar rights and can use the same email. If we deny a request, you can appeal by replying to our response.
EEA and UK residents may also object to processing based on legitimate interests, withdraw consent at any time, and complain to your local data protection authority. We don't make decisions about you based solely on automated processing that would have a legal or similarly significant effect. Shopify uses limited automated fraud screening (for example, temporarily blocking an IP address or card after repeated failed payments) that doesn't have such an effect.
Section 8How long we keep it, and how we protect it
We keep order records for as long as we need them for tax, accounting, warranty and dispute purposes — typically seven years. Account and marketing data stays until you delete your account or unsubscribe, after which we remove it within a reasonable period, except where the law requires us to keep it or we need it to resolve a dispute.
The store runs on Shopify, which is PCI-DSS Level 1 certified; payment card data is encrypted and never touches our own systems. We restrict staff access to customer data to people who need it to do their job. No system is perfectly secure, so if you believe your account has been compromised, contact us immediately.
Section 9Cookies
Cookies are small files placed on your device when you visit. We use them for:
- Essential functions — keeping items in your cart, remembering you're logged in, completing checkout, and security. The site doesn't work without these.
- Analytics and performance — understanding which pages and products people use so we can improve the site (Shopify analytics, Google Analytics).
- Advertising — showing you relevant ads on other platforms and measuring them (see Section 5).
- Preferences — remembering your country, currency and language.
Session cookies expire when you close your browser; persistent cookies last from 30 minutes to two years. Where the law requires it, you'll see a cookie banner where you can accept or decline non-essential cookies, and you can change your choice at any time from the link in the site footer. You can also block or delete cookies in your browser settings — allaboutcookies.org explains how — though parts of the site may stop working. Shopify publishes the full list of cookies it sets here.
Our site responds to Global Privacy Control signals by opting you out of sale/sharing. We don't currently respond to browser “Do Not Track” signals, because there's no agreed standard for what they should mean.
Section 10Children
Capsule NYC isn't intended for anyone under 16, and we don't knowingly collect personal information from children. If you believe a child has given us information, email info@capsuleclothingstore.com and we'll delete it.
Section 11International transfers
We're based in New York and our service providers store data in the United States, Canada and Ireland. If you're outside the US, your information will be transferred to and processed in those countries, which may have different data protection laws from yours. Shopify and our other providers use standard contractual clauses and equivalent safeguards for transfers out of the EEA and UK — Shopify explains this in its GDPR documentation.
Section 12Changes to this policy
We'll update this page when our practices change or the law requires it, and change the “last updated” date at the top. If a change is significant — for example, a new way we share data — we'll tell subscribers by email or post a notice on the site before it takes effect.
